1. Why would mortgage lenders need my complete bankruptcy papers?
 
Mortgage lenders often have different requirements for proof when financing a home. You should order the complete bankruptcy.  Sometimes ordering the "schedules and discharge" may not be enough.  Your case may have objections, reaffirmation aggreements, and amended schedules. Your lender will be able to advise you as to their preferences and requirements.
 
2. Is my Social Security Number displayed on my documentation?
 
Usually the Social Security Number has been blacked out and the last four digits are available for authentication.
 
3. When can I expect my Bankruptcy Documents?
 
All your documentation is retrieved on the same day that you place your order. Any files which have been archived by the courts will take 3-10 to retrieve. Any files that have been destroyed (25 years or more past filing) will not be available.
 
4. Can you open documents to view information?
 
No.  We can't open documents just to view and verify information.  For example, we will not open the schedules to check if a creditor is listed on the bankruptcy.  And if a case is recently filed, we will not check to see if there is a discharge yet.  
 
5. Who has access to my bankruptcy information?
 

Your bankruptcy documentation can be assessed by you, any creditors which were named in the bankruptcy filing, lending institutions or mortgage brokers, lawyers, loan officers, and anyone who has the authority to check your credit or who has access to your personal information.

 

 

6. I need to work with past creditors and clean up my credit rating now that I have filed for bankruptcy. What paperwork do I need?
 
You should order the complete bankruptcy case.  Some cases where there are discrepancies on your credit report or you need to provide additional proof to creditors or to the bureaus, you would require your entire file.
 
7. I filed my bankruptcy more than 7 years ago. Do I still need my paperwork in order to apply for credit?
 
This depends on which chapter you filed under. A Chapter 13 bankruptcy will stay alive on your credit for seven years after the discharge date, not the filing date. A Chapter 7 bankruptcy will stay alive on your credit for ten years after the discharge. If you apply for credit, your lender will tell you if you need to provide Schedules and Discharge papers, your entire file, or nothing at all.
 
8. I am not sure yet whether I need my bankruptcy file. Can I e-mail and see if it is available first just in case I need it?
 
Yes, you can e-mail us and we can tell you whether your file is immediately available, whether it has been archived, and even give you the cost and time of delivery.
 
9. I filed for bankruptcy and I am still being harassed by debt collectors. What am I supposed to do to make this stop?
 
For every creditor that contacts you, there is a simple and effective system that you should follow to prevent the continuation of hassling phone calls. Send your creditors a copy of your Schedules and Discharge papers. Send this via certified mail to be able to prove that you sent it in the first place. Then take about five minutes to file a complaint (make sure you know which debt collection agency is hassling you, not the company which you owe) with the Federal Trade Commission. They have a website with easy filing instructions. Your complaint can be tallied with others to audit the collection agency and to fine them for breaking the law. You have the right to peace post filing, and you need to file a complaint for every infraction that occurs.
 
10. What will I get if I order the Discharge papers package?
 
If If your case is closed, you will receive the discharge of dismissal record.  Because each case either has a discharge paper or dismissal paper. 

 

 

            11.  What is your refund policy?
All sales are final once it has been e-mailed, mailed or ordered from the archives.  If you order the Discharge package only and the case is still OPEN and not discharged yet, you will receive a refund minus $3.00. Fees are for research and paypal refund fees.
If you order the schedules package or complete bankruptcy package and there is no discharge or dismissal yet, you will be asked if you still want the bankruptcy documents.  And if so, we'll send all available documents.
12. What are page limit fees?
 
Any case exceeding 70 pages is subject to additional fee.  For example, if your case has 70-120 pages, you will have to pay additional $7.00.  Additional page limit fees can be found here.  
13. What is in a complete bankruptcy package?
You will recieve all bankruptcy documents.  We don't include BNC mailings (duplicate copy mailed out) or relief from stay exhibits, mortage papers (documents you would normally have).
